According to the Law of 18 July 2002 which implements Directive
2000/31/EC on Electronic Commerce, an opt-in model has been adopted
in Poland. Sending of unsolicited commercial material by means of
electronic communications is punishable by a fine. These are set
out in the Law
Concerning the Protection of Consumers' Rights
As from 10 March 2003 in Poland the
Law Concerning the
Provision of Electronic Services.
This law introduces some items from Directives 2000/31/EC and 2002/58/EC,
and it permits only opt-in form of marketing through electronic media
(it includes e-mail and SMS - fax will be included
in regulations still being prepared). The regulation also states strict
protection of customers' email addresses, which are treated as "personal
data".
